PRIVACY STATEMENT

(1/03/2007)

At Legacy Energy Management Solutions we value and protect your privacy. This Privacy Statement describes the types of information that we collect online concerning our customers and website visitors, and explains what we do with that information.

What Personally Identifying Information and Other Data We Collect

For each visitor to our website, we may receive information concerning the usage of our website by that visitor, including the visitor’s IP address, information concerning the visitor’s browser and/or operating system, and other access-related information. In addition, we (or a third party acting on our behalf) may use “cookies” or other tools in order to learn such things as whether an email is opened, how a visitor uses our website, which pages are viewed and for how long, and whether a visitor returns to our website.

We also collect data that you personally enter using the website. We may collect this information in connection with online inquiries, email correspondence, online registration, or your use of the customer-dedicated section (the “Customer Portal”) of our website. We may also collect other information about you generated as a result of our interactions with you, from third parties, and that you may directly provide us through any phone, mail, fax, or email interactions.

The information that we collect may include identifiable information (such as your company name and postal address), personal and company email addresses, any other data that you may submit through the Customer Portal, account preferences you choose to provide, and any documents or other information you submit to us using the internet. We may also maintain (or be able to change) any username or password selected or assigned to you when you register on our website. You should be sure to keep any such username and password confidential, and to let us know right away (using any of the contact methods below) if you believe that someone else may have learned your username or password.

How We Use Information and How You Can Control Such Use

The information we collect may be used to contact customers or prospective customers, to resolve problems, to maintain or improve our products and services, for marketing purposes, to enhance our website, and to meet any legal concerns or obligations. With respect to the Customer Portal, the information we collect is used to provide services to you, including assistance with maintenance and management of energy resources and your account with us.

Within our website you have the option to join our email list and receive emails containing information about our services and other matters that we believe you may be interested in. Sharing of Information

We provide to certain third-party service providers such personally identifiable or other information as is necessary for those third-party service providers to perform services for us, including database management, Internet services, payment processing, and marketing services. We require such third party service providers to confirm that their privacy practices are consistent with our privacy practices. We may also, on occasion, provide information to our affiliates (such as a parent or sister company, or a subsidiary of our company).

We will not provide email addresses or other personally identifiable information to any third parties for the marketing of third parties’ goods or services without your consent. However, in the event of a merger or acquisition of our company, the sale of substantially all of its assets related to the operation of our website, or other change of corporate control, all information we have collected online may be transferred to or controlled by the surviving or successor entity.

We may provide personally identifiable or other information in response to a lawful request from a law enforcement or government agency or in response to a formal request in a civil action that on its face meets the requirements for such a request. In addition, we may provide personally identifiable information to credit bureaus or collection agencies if we are permitted or required to do so by law.

In other respects, we will not share personally identifiable information with any entity for commercial purposes without your consent.

Use of “Cookies” and Similar Tools

“Cookies” and similar tools are essentially small pieces of information that are delivered and received by our website (or, in some instances, by our emails) and stored by your browser on your computer’s hard drive. We may use these cookies or similar tools to learn about visitors’ preferences and internet session information, to record user-specific information or the web pages that a visitor accesses and for how long. Among other things, cookies and similar tools permit us to tailor offerings to website visitor preferences, to improve our website and marketing email, and to provide better service to return visitors to our website. We do not use any information gathered using cookies or similar tools for any purpose other than our internet service, internal business, and marketing objectives.

Protection/Security

We employ reasonable security measures to protect sensitive information, including personally identifiable information, in our possession. While such measures include data storage encryption and authentication measures to protect against the loss, misuse, or alteration of sensitive information that we collect online from customers or other visitors on our website, no electronically stored information is completely secure. Consequently, while we strive to secure the information we have collected online concerning you, we cannot guarantee such security, and you ultimately provide such information at your own risk.
